ABOUT OUR SALES: This sale is the largest advertised sale in the country with catalogs mailed all over the United States & Canada. Each sale is advertised in numerous horse magazines, newspapers & the entire catalog is on our website. We have had over 10,000 hits. All catalogs are mailed at no charge upon request. We will continue the current advertising & increase it to bring more buyers to the sale. Every month we have at least 50 new buyers that attend the sale & our catalog mailing lists keep getting larger.

TO CONSIGN: Complete a Consignment Form, state the sale you are consigning to, mail or fax a copy of registration papers, (or a description of grade horses) remarks about your horse, coggins test (if available), catalog fee (See Below), your name, address and phone number (faxes received without name/address/phone # will not be included in catalog - please call to confirm receipt of fax). We have no way of contacting you if the fax isn't readable.

RULES AND REGULATIONS
1. Consignment fee of $85.00 per head. Commission 8%.

2. No pass out fee, however, you have the right to accept or refuse the final bid while horse is still in sale ring. If a horse is sold on grounds after it has been through the ring, that sale must still go through the sale office.

3. Catalog deadline is January 21st, 2019.

4. There will be NO SUBSTITUTES. Horses not cataloged sell last.

5. HORSES WILL BE SOLD IN CATALOG ORDER.

6. ORIGINAL REGISTRATION PAPERS WITH SIGNED TRANSFER OR $85 CONSIGNMENT FEE MUST ACCOMPANY SALE ENTRY OR HORSE WILL NOT BE CATALOGED. MAKE CHECKS PAYABLE TO R&J HORSE SALES.

7. A signed breeder’s certificate must accompany all bred mares and mares with foals at their sides.

8. INDIVIDUAL and ORIGINAL negative coggins test, within 6 months, will be required for each horse, which can accompany the horse on sale day.

9. Horses sold which are unsound in eyes, wind, are “windsuckers,” “cribbers,” or are of known lameness, must be so announced.

10. A new halter will be given to the buyer when payment is received.

11. Entries will be provided stalls and bedding by R&J Horse Sales. Bring your own feed.

12. Pictures are subject to a selection process. We limit the number we accept.

13. Your horse is cataloged for the benefit of advertising the horse and giving everyone a fair opportunity to bid on the horse. Once a horse is cataloged, we DO expect the horse to be brought to the sale. Upon execution of this contract, consignor agrees not to dispose of the horse by private sale. Any horse withdrawn from the sale, for any reason other than infirmity, will be assessed a $400 penalty in addition to the $85 catalog fee.

Sale days are very busy for the staff and management of R & J Horse Sales and it is difficult to extend this Thank You to each and every person attending the sale. We appreciate all the miles you travel to attend. Our goal is to make your visit enjoyable. We continue to increase our advertising and improve our facility and to provide buyers with as much information on the horses consigned and give the seller the greatest advantage, so their horse brings top dollar. Again, thank you for your support. The mixture of the types of horses consigned to the sale is great. It provides a horse that will suit all types of buyers.

CONSIGNORS: Please bring all the paperwork to the office the morning of the sale (unless you mailed it with your consignment). Make sure everything is in order and you have a breeders certificate on bred mares. Many buyers come into the office before purchasing a horse that interest them to check the papers. If all necessary papers are not in the office they are hesitant to bid.

  We do not allow back alley trading – sale of all horses must go through the sale ring & office.

Buyer's Responsibility - The Buyer has a responsibility to examine a horse carefully before they bid on it. If you have any particular concerns about conformation faults or defects, size, attitude, stall manners, riding ability or anything else, check it out BEFORE you bid. If you buy a horse on impulse, without shopping it before you bid, you may expect to find some surprises. In that case you still own the horse. The seller is not responsible for you, if you don’t shop the horse. Once you bid on a horse, you are indicating you have shopped enough to satisfy yourself and no one else is responsible.

TERMS AND CONDITIONS


1 . The Sales management acts only as an agent. ALL RESPONSIBILITY AND GUARANTEES ARE BETWEEN BUYER AND SELLER .

2 . The highest bidder will be the buyer, and if dispute arises between two or more bidders, the horse in dispute shall immediately be put up again for advance bids . If there be no advance bids, the horse shall go to the person from whom the auctioneer recognized the last bid . The auctioneer will decline any bid made by parties who have defaulted in former purchases, or by persons who, in his judgment, are not responsible bidders .

3 . Terms of sale are cash and payment in full to be made to the cashier immediately after the sale .

4 . Upon receiving payment for a horse, the cashier will issue an order to obtain delivery. Buyers are cautioned not to lose these orders . Buyers assume all expenses and risks on horses after they have left the auction ring . Buyers must make arrangements with the sale company for care of stock until it can be removed .

5 . Upon failure of compliance with any of the above conditions, the lot shall be resold by public or private sale, and the deficiency (if any) attending such resale shall be made good by the defaulter immediately.

6 . If any person shall purchase a lot and not pay for it as prescribed above, nothing shall prevent the auctioneer or the owner from compelling the purchaser to pay for it if the auctioneer or seller shall so deem fit .

7 . Every effort has been made to ensure correctness of the catalog but the sales management and auctioneer are not responsible for errors or omissions, and assume no liability on its part or on the part of the seller as to any statements, either verbal or written, regarding horses sold .

8 . All known defects will be announced before each horse is started . Every horse will be sold under this rule . Therefore, no horse can be rejected by buyer when struck off by auctioneer. The seller guarantees all mares were bred to stallions as indicated in the catalog . We believe them to be in foal, but are selling them as they are and without return privileges, unless otherwise specified.

9 . Immediately after the horse is sold, it will be the sole risk and responsibility of the buyer thereof, but possession of the horse cannot be obtained by him until payment in full has been made .

10 . Buyers and spectators are cautioned to be careful while on the grounds and particularly while horses are being shown in the ring . The management cannot be responsible for any accidents .

11 . New and used trailers for sale on the grounds .

12 . Consignors are reminded to bring registration papers, breeding certificates, signed transfers and coggins tests the day of the sale . They should be turned in to the office before the sale .
13 . REGISTRATION PAPERS WILL BE GIVEN TO THE BUYER AS SOON AS CHECKS HAVE CLEARED . PAPERS WILL BE ISSUED ON CASH, CERTIFIED CHECKS, OR MONEY ORDERS .
